Dear Experts,

Under the new legislation, people who have applied for independent skilled visa before 1 July 2010 are permitted to change their visa category to 176 by obtaining a state sponsorship. It is said that this can expedite the processing of their application.

The question is: After receiving the state sponsorship, do they need to lodge a new application and pay the relative fees or they can simply add their sponsorship to their current application and change their subclass without paying additional expenses.

I believe that during the upcoming months this will be a common question, so your kind reply is highly appreciated.

I originally posted saying that this is a question I wanted to as too, but after seeing Susan's latest post about the new SMP FAQ's released, I realised the answer was there (http://www.immi.gov.au/skilled/general-skilled-migration/pdf/statmi...):

Applications for permanent visas lodged before 1 July 2010
Applicants who applied for either a Skilled (Residence) or Skilled (Migrant) visa (subclasses 175, 176, 885 and 886) before 1 July 2010 are able to seek a nomination under a Plan and have their application assessed on the basis of having a state or territory nomination.

I therefore believe we will not need to reapply. I'm a C# .Net developer and concerned if my skill assessment is not transferable to the new code system! I see Victoria requires my skills but using the ANZSCO system! (http://www.liveinvictoria.vic.gov.au/__data/assets/pdf_file/0020/22...)

Well, I think the answer to Q10 is not clear enough.It's mostly a general answer rather than a clear instruction.
Unfortunately, particularly from Sep 2009 we have faced a huge deal of unclear answers.
A good instance is your concern about your skill assessment.

Some of the questions which remain unanswered even after reading the FAQ you referred to are:
1- Will a 175 or 885 applicant- lodged prior to July 1st- need to lodge a new application under 176 after receiving a state sponsorship OR his/her application will automatically change to 176 upon sending the sponsorship to DIAC.

2- For those applicants who have assessed their skills more than 12 months ago under ASCO, is it necessary to obtain a new skill assessment under ANZSCO in order to apply for state sponsorship?

and.....

I think that calling DIAC maybe a good way to find the answers to above questions; however, I'm not sure.
