New SOL, Points for Occupations and State Sponsored Lists are now available

Hi everyone

 

Instrument IMMI 10/026, which sets out the new Skilled Occupation List and a list of occupations that can be sponsored by States has now been published.

The new SOL starts on page 29 (Schedule 3) and includes points for occupations and assessing bodies; the new State Sponsored List starts on page 37 (Schedule 4).

It means, states have to chose the occupations from Schedule 4, and they cant have the occupations in their SMP's if it is not in Schedule 4. Am I correct?

States will separately come up with the occupations in demand in their states . But they are bond to choose these occupations from this new list which is published on the schedule 4. Susan please correct me If I am wrong..

They have to select this from Schedule 4. But as it was earlier that there were some off-list occupations, but it has not been clarified by DIAC that whether they will include off-list occupations too.

Priya, re your question about occupations that are able to be included in SMPs, DIAC did indicate that each State would have 100 places for "off-list" occupations, so there does seem to be a small amount of flexibility available. DIAC hasn't yet officially confirmed that advice though.

Hi Susan,

Are the occupations in schedule 4 common to all states or will each state "select" occupations off that list that are of interest to them and exclude others (example: will an environmental consultant - 234312 be common to every state or only those states that need them)?

So the guys whose occupation is not in schedule 4 may have some hope.
Hi everyone

Gary, I imagine States and Territories will select the occupations that are of most use to them, from the list of occupations on Schedule 4. But we will need to wait for the State Migration Plans to be published to confirm that.

Jackd, the new Skilled Occupation List and State Sponsorship List will affect all applications lodged with DIAC after 1 July. There is a range of transitional provisions which will affect applications currently being processed, but in general terms, DIAC's current policy is that applications that were on the previous SOL will continue to receive priority and those that were not on the current SOL are still expected not to be processed until 2012. That, of course, could change at any time, as we have observed across many other immigration policy areas recently.

DIAC hasn't been absolutely clear about how current state sponsored applications will be treated - I imagine that announcement will be made when the State Migration Plans are published.

Atul, Schedule 3 is the new Skilled Occupation List, which comes into effect on 1 July. That is the list of occupations that will apply to new independent skilled migration applicants if they apply for skilled migration after that date.

Schedule 4 is the new list of occupations that can be sponsored by States and Territories. That is the list that people will need occupations on if they are seeking State Sponsorship after 1 July this year.

Riva, DIAC did say that States and Territories would also be able to offer 100 "off list" sponsored places each year, for occupations that were not on the State Sponsored list, but no further information has been provided about that yet. If that is still the case, people whose occupations are not on Schedule 3 or 4 might be able to be sponsored under an "off list" place.

Hope that helps to clarify the issues everyone's raised.
